Terms of Service

1. Agreement to Terms

These Terms of Service ("Terms") are a legally binding agreement between you ("you") and DASTEM Digital OÜ ("Company", "we", "us"), trading as AI Testing Tools, governing your use of https://www.testingtools.ai, our free AI tools and associated services (the "Service"). By using the Service you agree to these Terms. If you don't agree, please don't use the Service.

If you use the Service on behalf of a company, you confirm you're authorised to accept these Terms for it.

2. The Service

AI Testing Tools is a directory of AI-powered software testing tools with reviews, a blog, free AI tools, and paid promotion options for tool makers.

  • The Service is provided "as is" and "as available". We may change, suspend or discontinue features at any time.
  • Directory content is provided for information only. We do our best to keep it accurate but don't guarantee it, and we're not responsible for third-party tools or websites we link to.

3. Accounts

  • You sign in with a one-time link sent to your email address, or with Google or GitHub. Keep access to that email or account secure: whoever controls it can use your account.
  • Give accurate information, and don't create accounts with disposable email addresses or to get around limits.
  • You must be at least 16 years old.
  • You can delete your account at any time in Dashboard → Account.

4. Acceptable Use

You agree not to:

  • Break any law or infringe anyone's rights, including intellectual property rights.
  • Submit false, misleading, defamatory or harmful content, or impersonate a company or person.
  • Attempt to gain unauthorised access to the Service, disrupt it, or scrape it at a rate that affects other users.
  • Transmit malware or use the Service to attack others.
  • Abuse free tools, for example by creating multiple accounts to exceed usage limits.

5. Tool Listings and Claims

  • Submissions: anyone can submit a tool for free. We review every submission and may edit, reject or later remove a listing at our discretion, for example if it's inaccurate, not relevant to software testing, or breaks these Terms.
  • Claims: you may only claim a listing for a product you're authorised to represent. Claims from an email address on the tool's own domain are approved automatically; others are verified by us. We may revoke ownership obtained by misrepresentation.
  • Your content: you keep ownership of the content you submit (texts, logos, screenshots). You grant us a worldwide, non-exclusive, royalty-free licence to host, display, adapt (for example resize or format) and promote it as part of the Service, for as long as the listing is published and for a reasonable time after for backups. You confirm you have the rights to grant this licence.
  • Edits: edits to published listings may be reviewed before they go live. Changing a listing's name or website always needs our review.
  • Editorial independence: our own reviews and rankings are editorial. Payment affects badges and placement as described in section 7, not our editorial assessment.

6. Our Intellectual Property

The Service, its software, design, texts and directory content created by us are our property. You may not copy, republish or create derivative works from them, except for normal browsing and sharing of links, without our permission.

7. Paid Services

  • Verified listing: a one-time payment for one listing. It adds a Verified badge, higher placement in the directory, instant publishing of edits and priority review, for as long as the listing remains published and complies with these Terms. It can't be transferred to another listing.
  • Featured Listing: 30 days from the start date you choose, for a published, Verified listing. Up to three tools can be featured at the same time.
  • Top Sponsor Bar: 30 days from the start date you choose, one sponsor at a time. It includes the sponsor bar on every page and a pop-up shown once per visitor. Your message, link and logo must follow these Terms and are reviewed before they go live; we may ask you to change them. If we approve the message after your start date, the 30 days start on the day of approval.
  • Prices and payment: prices are shown in US dollars and exclude VAT, which is added at checkout where applicable based on your billing details. Payments are processed by Stripe, and you'll receive an invoice by email.
  • Cancellations and refunds: you may cancel a Featured Listing or Top Sponsor Bar booking for a full refund before its start date by contacting us. If we reject a paid submission or sponsor message and it isn't corrected, or we can't deliver a booking, we refund it. Otherwise payments are non-refundable once the service has started, except where the law requires otherwise.
  • Removal: if we remove a listing or promotion because it breaks these Terms, the related payment is not refunded.

8. Termination

We may suspend or close your account, or remove your listings and promotions, if you break these Terms, if we suspect fraud, or if required by law. You may stop using the Service and delete your account at any time.

9. Disclaimers and Limitation of Liability

  • We make no warranties, express or implied, beyond those that can't be excluded by law, and we don't guarantee any particular results from listings, promotions or tools.
  • We're not liable for indirect, incidental or consequential damages, or for loss of profits or data.
  • Our total liability is limited to the amount you paid us in the 12 months before the claim.
  • Nothing in these Terms limits liability that can't be limited by law, such as for intent or gross negligence.

10. Indemnification

You agree to indemnify us against claims arising from content you submit, your use of the Service in breach of these Terms, or your infringement of someone else's rights.

11. Changes to These Terms

We may update these Terms. We'll post the new version on this page and update the date above; for significant changes we'll notify account holders by email. Continuing to use the Service after a change means you accept it.

12. Governing Law and Jurisdiction

These Terms are governed by the laws of Estonia. Disputes are subject to the courts of Estonia. If you are a consumer in the EU, you may also bring proceedings in your country of residence and keep the protection of its mandatory consumer laws.

13. Consumers in the EU

Our paid services are intended for businesses. If you buy as a consumer, you have a 14-day right of withdrawal from distance contracts. By asking us to start a promotion or apply a Verified badge before that period ends, you agree that the service starts immediately and that you lose the right of withdrawal once it has been fully performed; for a service already started, a proportionate amount may be charged.

14. Business Structure

We may transfer our rights and obligations under these Terms to another entity as part of a change of business structure or ownership. This won't reduce your rights under these Terms.
